Summary

The Employment Rights Bill is still making its way through Parliament, with several proposed amendments now on the table in the House of Lords.

 

One of the most significant changes is a proposal to make NDAs covering harassment or discrimination between an employer and a worker void.

This reflects growing pressure from campaigners, particularly following the #MeToo movement, who have long called for tighter restrictions on their use.

Notably, this provision was absent from the Bill’s original draft.

 

If introduced, the ban would represent a major shift for employers who routinely include confidentiality and non-disparagement clauses in settlement agreements.

The government has suggested that some NDAs may still be permissible in narrowly defined ‘excepted agreements’, but further detail is awaited.
